Hereinafter referred to as “SCREW-EXPRESS”.

All goods are shipped from France.


2. SCOPE OF APPLICATION

These General Terms and Conditions of Sale (GTCS) apply to all sales concluded via www.screw-express.com to customers located in the United Kingdom.

They apply to:

  • Consumers (B2C)

  • Businesses acting in the course of trade (B2B)

Specific provisions are clearly distinguished where applicable.

The applicable GTCS are those in force at the date of the order.


3. PRODUCTS

Products (fasteners, screws, bolts, mechanical components) are intended for technical and industrial use.

Technical specifications, dimensions, tolerances, weight and images are provided for information only and do not constitute a contractual guarantee.

The customer is solely responsible for verifying:

  • Product suitability

  • Compliance with UK standards

  • Proper application and installation


4. ORDERS

An order becomes binding:

  • Upon full payment

  • Upon written confirmation by SCREW-EXPRESS

SCREW-EXPRESS reserves the right to refuse abnormal or high-risk orders.

4.1 Consumers (B2C)

Orders may be cancelled before dispatch processing begins.

4.2 Businesses (B2B)

Orders are firm and non-cancellable unless expressly agreed in writing.


5. PRICES – VAT – IMPORT DUTIES

Prices are stated:

  • Excluding VAT for businesses

  • Including VAT where applicable for consumers

  • Excluding shipping costs

Brexit – Import to the UK

Goods are exported from France and imported into the UK.

Unless otherwise agreed:

  • The customer is responsible for UK import VAT

  • The customer is responsible for customs duties

  • The customer is responsible for customs clearance

If Delivered Duty Paid (DDP) is agreed, import charges will be invoiced accordingly.

Applicable prices are those at the time of order confirmation.


6. DELIVERY

Delivery is made from France to the UK.

Delivery times are indicative only.

Reasonable delay shall not entitle the customer to:

  • Cancel the order

  • Claim damages

  • Refuse delivery

Except where mandatory consumer protection laws apply.

Customers must inspect goods upon receipt.


7. TRANSFER OF RISK

B2C

Risk transfers upon physical receipt of goods by the consumer.

B2B

Risk transfers when goods are handed to the carrier in France.


8. RIGHT OF WITHDRAWAL (B2C ONLY)

Consumers have the right to withdraw within 14 calendar days from receipt of goods.

To exercise this right, written notification must be sent before expiry of the withdrawal period.

Refunds will be processed within 14 days after receipt of returned goods.

The right of withdrawal does not apply to:

  • Custom-made products

  • Personalised items

  • Modified or specially prepared goods

  • Products unsuitable for resale for technical reasons

Return shipping costs are borne by the consumer.


9. WARRANTIES

9.1 Consumers (B2C)

Consumers benefit from statutory consumer rights under applicable UK consumer legislation.


9.2 Businesses (B2B) – LIMITED WARRANTY

For businesses, warranty is strictly limited to:

  • Replacement of defective goods
    or

  • Refund of defective goods

Excluded:

  • Loss of profit

  • Business interruption

  • Contractual penalties

  • Indirect or consequential damages

Claims must be made:

  • Within 8 calendar days for visible defects

  • Within a reasonable time for hidden defects

Failing this, goods are deemed accepted.


10. LIABILITY LIMITATION

SCREW-EXPRESS liability is strictly limited to the amount of the order.

For B2B customers, SCREW-EXPRESS shall not be liable for:

  • Incorrect product selection

  • Improper installation

  • Non-compliance with UK regulations

  • Structural miscalculation

  • Misuse

The customer is solely responsible for technical validation.

Nothing in these terms excludes liability for death or personal injury caused by negligence or fraud, where such exclusion is unlawful.


11. HYDROGEN EMBRITTLEMENT – SURFACE TREATMENTS

Electroplated high tensile fasteners may present a risk of hydrogen embrittlement.

Professional customers:

  • Confirm awareness of this risk

  • Accept full responsibility for technical validation

  • Undertake required testing

No liability shall arise in this respect.


12. PAYMENT

Payment is due at order unless agreed otherwise in writing for B2B accounts.

No discount for early payment.


13. LATE PAYMENT (B2B)

In case of late payment:

  • Statutory interest applies

  • Fixed compensation of €40 for recovery costs

  • Penalty clause of 10% (minimum €50)

  • Suspension of deliveries

  • Immediate payment of all outstanding sums


14. RETENTION OF TITLE

Goods remain the property of SCREW-EXPRESS until full payment is received.

In case of resale by a business customer, receivables are automatically assigned to SCREW-EXPRESS up to the outstanding amount.


15. DATA PROTECTION

Personal data is processed in accordance with GDPR and applicable UK data protection laws.

Privacy policy is available on the website.


16. FORCE MAJEURE

SCREW-EXPRESS shall not be liable for events beyond its reasonable control, including:

  • Supply shortages

  • Transport disruption

  • Energy crisis

  • Government restrictions

  • Customs delays


17. GOVERNING LAW – JURISDICTION

These Terms are governed by French law.

B2B

Exclusive jurisdiction: Commercial Court of Le Mans (France).

B2C

Consumers may bring proceedings:

  • Before UK courts
    or

  • Before French courts

In accordance with applicable international regulations.
